Terms of Service

Effective: May 6, 2026

These Terms of Service (the “Terms”) govern your access to and use of the BassRadar iOS application (the “App”) operated by Clutch Click (“we,” “us,” or “our”). By downloading, installing, or using BassRadar, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility & account

You must be at least 13 years old to use BassRadar. You are responsible for everything that happens under your account, and for keeping your Apple ID secure. You agree to provide accurate information and to update it as needed.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use BassRadar on an iOS device that you own or control, for your personal, non-commercial use. The App is licensed, not sold.

3. Subscriptions, free trial, and billing

  • BassRadar is a paid subscription. Plans are: Monthly at $4.99/month and Annual at $39.99/year (prices in U.S. dollars; local pricing may vary by Apple App Store region).
  • The Annual plan includes a 7-day free trial for eligible new subscribers. If you do not cancel before the trial ends, the subscription will auto-renew at the then-current price.
  • Subscriptions auto-renew through your Apple ID until canceled. Cancel anytime in Settings > [your name] > Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period.
  • Apple manages payment, refunds, and renewal. Refund requests go through Apple at reportaproblem.apple.com.
  • Prices may change. We’ll provide notice and an opportunity to cancel before any change applies to your subscription.

4. Forecast disclaimer — this is the important one

BassRadar is a forecasting and decision-support tool. The BiteRating, Pattern Predictor outputs, push alerts, and any weather, lunar, or condition data are provided as-is for informational purposes only.

  • BassRadar does not guarantee that fish will bite, that any particular lure or technique will work, or that conditions on the water will match the forecast.
  • Always check official weather sources and local advisories before heading out. Storms, lightning, high water, ice, and changing wind conditions can be dangerous. Use your own judgment.
  • You are responsible for following all applicable fishing laws, bag limits, slot limits, license requirements, season dates, and access rules. BassRadar does not provide legal advice on local regulations.

5. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
  • Use the App in any way that violates applicable law, including fishing or environmental regulations;
  • Upload content that is illegal, infringing, harassing, or that you do not have rights to;
  • Interfere with or disrupt the App, our servers, or the third-party services BassRadar relies on;
  • Use BassRadar to build a competing product, scrape its outputs at scale, or train another model on its outputs.

6. Your content

You retain ownership of the catches, photos, notes, and other content you submit to BassRadar (“Your Content”). You grant us a worldwide, royalty-free license to host, store, and display Your Content solely to operate and provide the App to you. We do not publish Your Content publicly, do not sell it, and do not use it to train AI models.

7. AI Fishing Intel

The Pattern Predictor selects from a curated catalog of zones, lures, and techniques using a large language model. Outputs are recommendations, not guarantees. We do not warrant that any specific recommendation will lead to a catch or that conditions described will match what you encounter on the water.

8. Third-party services

BassRadar incorporates services from Apple, Google (Firebase), Open-Meteo, OpenRouter, and RevenueCat. Your use of those services through BassRadar is also subject to their terms and privacy notices. We are not responsible for outages, data loss, or errors originating from those providers.

9. Updates

We may release updates that add, change, or remove features. We may also stop offering BassRadar or any feature at our discretion. We will not intentionally degrade your access to a paid feature during an active billing period; if we discontinue the App entirely during a paid period, we will issue a prorated refund through Apple where feasible.

10. Termination

You may stop using BassRadar at any time and delete your account from within the App. We may suspend or terminate your access if you breach these Terms or use the App in a way that creates risk for us or other users. Sections that by their nature should survive termination (disclaimers, liability limits, dispute resolution) will survive.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASSRADAR IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF FORECAST DATA. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CLUTCH CLICK OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, FISHING TRIPS, OR FISH NOT CAUGHT, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF BASSRADAR. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNTS YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to defend and indemnify Clutch Click against any claims, damages, or expenses arising from your misuse of the App, your violation of these Terms, or your violation of any law or third-party right.

14. Apple-required terms

You acknowledge that these Terms are between you and Clutch Click, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support. In the event of any failure of the App to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for any third-party claims relating to the App or your possession or use of it. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law

These Terms are governed by the laws of the State of Texas, U.S.A., without regard to conflict-of-laws principles. The federal and state courts located in Texas will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. If changes are material, we’ll notify you in the App or by updating the “Effective” date. Continued use after an update constitutes acceptance of the new Terms.
